The Answer...
Even though the unvented cylinder had only been installed three years ago scale had already formed so badly around the phial that it had created a insulating thick coat of lime-scale all around it which in turn was preventing the thermostat sensing the correct temperature of the water inside the cylinder.
Not something that you normally think of is it?
It caused quite a debate amongst us all (which I think is what the assessor intended it to do).

The answer of a scale build up would of never been a thought in my mind - our area doesn't really have that problem, yes after thirty years not three. qwerty

It's not something obvious is it, that's why no-one thought of it.
All these course delivers seem like to tell stories like these to their captive class (perhaps as a bit of light relief).
Is it true though?
It sounds viable, I must admit.
The RGI tale.....
9 months after fitting a new combi boiler this RGI was called back to the property by gas safe apparently the RGI had left the customer with a serious gas leak which was a full drop on the gauge. On arrival the gas safe inspector showed him the job to which he replied "Will you wait why I nip back home I've something I want you to see". Arriving back at the property The RGI showed the gas safe a photo adding "that's how I left it". Since The RGIs visit a new tee had been cut into the gas supply and a new section had been added by someone else and the leak was on an elbow on the newly installed section of gas pipe!
The moral of the tale is to "Always cover yourself" said the assessor.......

A similar thing happened to me, not gas but water, I got a call 8/9 months from doing a boiler change, the client was blaming me for a soldered joint leaking and damaging their kitchen, they wanted a new kitchen,floor and cieling, I had no choice but to give them my public liability insurance details,,,anyrode long story cut short, they tryed to claim £35.000 and after my insurance claims investigator got the facts from me, they got prosecuted for false claim, the moral of my story is, always have insurance, without the legal beagles behind you, you can end up in DEEP SHIT,

It's sad that they are people willing to try these scams on innocent tradespersons.
At least they got their Como pence in the end.
