When hot water is on (no call for heat) some rads upstairs get warm
Could this be the 3 port letting by?
Downstairs rads remain cold.

It could be that rocky BUT, sometimes if the pipework is wrong, That can happen so, we need more history like, did it work ok once, Is it a new customer knowing the problem and trying it on, Or maybe its a owner who's just moved in,  |

But now it does. That’s why I’m thinking 3 port I know some systems are piped do the towel rad will heat up but again he said it used to be cold. |

I agree with Tom, sounds like the Mid Poss Valve passing.
Check the Return is piped with the 3 Tee Rule.
The Cylinder Return connects to the common return as the first Tee nearest the Boiler.

See if the pump is running for an extended period of time when the boiler has finished its run request, as you’ll get residual heat circulating to any item close to the valve.
